Please Read Carefully Before Signing
In consideration of being permitted to participate in any way in the Martial Arts Program indicated below and/or being permitted to enter for any purpose any restricted area (here in defined as any area where in admittance to the general public is prohibited), the participant, or the parent(s) and/or legal guardian(s) of the minor participant named below agree.

The participant or the parent(s) and/or legal guardian(s) will instruct the minor participant that prior to participating in the below martial arts activity or event, he or she should inspect the facilities and equipment to be used, and if he or she believes anything is unsafe, the participant should immediately advise the officials of such condition and refuse to participate. I understand and agree that , if at any time, I feel anything to be UNSAFE; I will immediately take all precautions to avoid the unsafe area and REFUSE TO PARTICIPATE further.

I/We fully understand and acknowledge that:

There are risks and dangers associated with participation in martial arts events
and activities which could result in bodily injury, partial and/or total disability, paralysis and death.

The social and economic losses and/or damages, which could result from these risks and dangers described above, could be severe.

These risks and dangers may be caused by the action, inaction, or negligence of the participant or the action, inaction, or negligence of others, including, but not limited to, the Releasees named below.

There may be other risks not known to us or are not reasonably foreseeable at this time.

I/We accept and assume such risks and responsibility for the losses and/or damages following such injury, disability, paralysis or death, however caused and whether caused in whole or in part by the negligence of the Releasees named below.

I/We HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the martial arts facility used by the participant, including its owners, managers, promoters, lessees of premises used to conduct the martial arts event or program, premises and event inspectors, underwriters, consultants and others who give recommendations, directions or instructions to engage in risk evaluation or loss control activities regarding the martial arts facility or events held at such facility and each of them, their directors, officers, agents, employees, all for the purpose herein referred to as “Releasee”... from all liability to the undersigned, my/our personal representatives, assigns, executors, heirs and next to kin. For any and all claims, demands, losses or damages and any claims or demands therefore on account of any injury, including but not limited to the death of the participant or damage to property, arising out of or relating to the event(s) caused alleged to be caused in whole or in part by the negligence of the releasee or otherwise.

I/We HEREBY acknowledge that THE ACTIVITIES OF THE EVENT(S) ARE VERY DANGEROUS and involve the risk of serious injury and/or death and/or property damage. Each of THE UNDERSIGNED also expressly acknowledges that INJURIES RECEIVED MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES OF THE RELEASEES.

EACH OF THE UNDERSIGNED further expressly agrees that the following release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the province or state in which the event is conducted and that if any portion is held invalid, it is agreed that the balance shall, notwithstanding continue in full legal force and effect.

On behalf of the participant and individually, the undersigned partner(s) and/or legal guardian(s) for the minor participant executes this Waiver and Release. If,despite the release, the participant makes a claim against any of the Releasees, the parent(s) and/or legal guardian(s) will reimburse the Releasee for any money which they have paid to the participant, or on his or her behalf, and hold them harmless.

The undersigned participant and/or legal guardian(s) for the minor participant agree that any dispute concerning, relating to, or referring to this Waiver shall be resolved exclusively by binding arbitration according to the then existing commercial rules of the American Arbitration Association (“AAA”). Such proceedings will be governed by the substantive law of Iowa, without reference to any conflict of law rules. Nothing in this section shall require the parties to use the services of the American Arbitration Association. The Arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability or formation of this Waiver, including but not limited to any claim that all or any of this Waiver is void or voidable. I understand that I am giving up any right that I may have to a jury trial or to bring claims in court against Liberty Grappling Club, LLC. I agree that payment of all filing, administration and arbitrator fees will be governed by the AAA’s rules, and that the arbitrator shall be entitled to award attorney’s fees as permitted under Iowa law. Judgment on the award rendered by the arbitrator(s) may be entered in court having jurisdiction thereof. Should any party to this Waiver hereafter institute any legal action or administrative proceeding against the other by any method other than by binding arbitration as specified in this paragraph, then the responding party shall be entitled to recover from the initiating party all damages, costs, expenses, and attorney’s fees incurred as a result of such action if the responding party prevails in having the legal action or administrative proceeding referred to arbitration in accordance with this arbitration provision. The venue for any court proceedings concerning, relating to, or referring to this Waiver shall be exclusively the federal or state courts located in the state of Iowa.

Copyright; Use of Images: The martial arts courses/classes/events are copyrighted by Liberty Grappling Club, LLC. Video, audio and/or other means of recording the courses/classes/events by the participant, parent/legal guardian, guests of either or the general public are strictly prohibited. Violators will be dismissed from the course/class/event/facility and the business reserves all legal rights to pursue legal remedies. To inquire about obtaining a professional recording of the Event, please contact business. Customer for him/herself and his/her/its officers, directors, employees, agents,representatives, successors, assign, heirs, executors and administratives hereby irrevocably hereby consents to the unrestricted use by Business, its advertisers, clients customers, successors, and assigns of Customer’s name, likeness, statements, photograph or motion picture, for advertising, sale, marketing, promotion or any purposes of trade and Customer waives the right to inspect or approve such completed images used in connection therewith. Customer grants to Business the exclusive right to exploit and license to assign for exploitation all such matter or any approved derivatives thereof in any manner in any medium or field of use, in the form delivered.

Code of Conduct & Right to Refuse Service: Liberty Grappling Club, LLC (LGC) requires that all students, participants and guests follow the LGC Code of Conduct while on LGC property and while enrolled as a participant or as an active student or member. Students, participants and guests who fail to follow the Code of conduct can and will be refused service and any agreement made for services will be terminated. LGC reserves the right to refuse service to anyone who does not follow the Code of Conduct, is a safety risk to themselves and others, exhibits dangerous behavior or otherwise disrupts the course of business operations. LGC is not required to give warnings for infractions and can terminate services and agreements at the first infraction of the Code of Conduct or for any of the reasons stated above. Students wil receive a copy of the Code of Conduct upon enrollment. Participants in Trial Programs and guests can receive a copy upon request.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

TERMS & CONDITIONS OF ADULT TRIAL PROGRAMS

Missing or Not Attending Classes During the Trial Program: Missing or not attending a class does not extend the Trial Program for the Participant.

End of Trial Program: At the end of the trial period, the Trial Program is over regardless of how many classes the Participant attended or failed to attend. Any portion of the Trial not used is null and void, and LGC is not required to provide the Payer or the Participant with further goods or services or provide a refund, return or exchange of goods or services. If/When the Participant completes all of the lessons offered or notifies LGC that they no longer wish to continue the program is also ended.

Refunds & Exchanges: Refunds are available prior to the start of the participants first lesson (Private Lesson, Semi-Private Lesson orGroup Lesson). Following the start of the first Lesson all sales of goods and services are final and no refunds or exchanges will be given.

Use with other Offers: Trial Programs are for new students only and cannot be used in conjunction with any other coupon, discount or offer.

Early Termination: In addition to the terms stated above in the waiver of liability, LGC reserves the right to cancel this agreement and Trial Program and refuse service as it sees fit or if the participant or the environment is deemed to be unsafe to continue training. If the Participant is deemed to be a safety hazard to themselves or others because of health, fitness, personal or behavioral issues LGC reserves the right to terminate this agreement and discontinue services.

Continuation of Waiver: Should the Participant enroll as a full time student this waiver of liability as written above shall continue and remain in effect for the duration of the student’s enrollment unless it is replaced with a newer version which will then also be signed by the participant or their parent/legal guardian.
The signature of the Parent/Legal Guardian or the Payer’s signature below further acknowledges that you and/or the payer has read and accepts the terms and conditions of the Trial Program offer.
